General
These terms of use ("Terms") apply to the AI Commerce online store platform ("Service"), owned and maintained by 3180370-3 ("Service Provider"). By opening the Service and/or registering as a user, you agree to abide by these terms of use. Use of the Service is not permitted if you do not accept these terms.
Registration to the Service
Using the service requires registration. By registering, you confirm that you have read these terms of use. The service provider will open the online store (the "Online Store") and access to the Service after registration. Registration is free and does not obligate you to use the Service.
Changing payment and service packages
The prices for the service are presented and billed in euros. The cost of the service is determined by the selected Service Package. The service provider has the right to change the prices unless otherwise agreed, and the new prices will take effect in the next billing period. The customer is entitled to change their service package as their needs change.
Entry into force and termination
The agreement will come into effect from the date of registration and will be valid for billing periods. The customer can terminate the agreement without any separate grounds.
Announcements and notifications
The service provider can deliver notifications and announcements through the website, email, or the Service. The customer must follow the announcements and act accordingly.
Intellectual property rights
The customer owns the user interface and all its own data. The back-end of the e-commerce platform is a SaaS solution, and the customer does not have ownership rights to it. The service provider has the right to use the customer's materials for the provision of the Service.
Providing and using the service
The service is provided as is. The service provider does not guarantee the uninterrupted or error-free operation of the service. The service provider has the right to change or discontinue the provision of the service.
The content and trade of the online store
The service provider is not a party to the trade occurring in the online store. The customer is responsible for all business conducted through the online store and its legality.
Privacy Policy
The parties commit to complying with the applicable data protection legislation. The customer is responsible for the personal data included in the material as the data controller. The privacy protection is subject to the Service Provider's privacy policy.
Responsibilities and limitations of liability
The service level agreement (SLA) defines the following compensations:
Credits for service availability: If the service availability falls below [99.99% per month], the customer will receive a credit of 10% of the monthly fee for each percentage point.
Compensations for performance shortfalls: If performance does not meet the SLA criteria, the customer will receive a percentage of the monthly fee, depending on the extent of the performance degradation.
Priority support: If the level of support service is not met, the customer will receive priority support or free consulting services as compensation. Additional services: Customers will be offered additional services for failing to meet the SLA conditions.
Right to terminate the contract: In serious and repeated SLA violations, the customer has the right to terminate the contract without penalties.
Other terms
If any part of the terms and conditions is deemed illegal or invalid, this does not affect the validity of other provisions. The customer cannot transfer the contract to a third party without the service provider's consent.
Applicable law and disputes
These terms and conditions are governed by Finnish law. Disputes will be attempted to be resolved amicably, and if an agreement cannot be reached, they will be resolved in the District Court.
